Nintendo sues U.S. over Trump-era import tariffs

Nintendo has filed a lawsuit against the United States government, challenging import tariffs imposed during the Trump administration and asking for refunds of duties it says were unlawfully applied.

Who was named and where the case was filed

The complaint lists the Treasury Department, the Department of Homeland Security and U.S. Customs and Border Protection as defendants. Nintendo lodged the case with the U.S. Court of International Trade.

Legal basis for the challenge

In its filing, Nintendo anchors its argument to a February Supreme Court decision that upheld lower-court rulings finding the global tariffs put in place during the Trump administration to be unlawful. The company’s lawyers say Nintendo suffered “substantial injury due to the execution and enforcement of unauthorized Executive Orders.”

The suit seeks recognition of that injury and reimbursement of tariffs Nintendo paid to import its products into the United States.

Potential consequences for industry and pricing

The lawsuit underscores Nintendo’s effort to protect its commercial interests and pursue a more predictable legal and business environment. The company’s move could create precedents affecting other firms that import large volumes of goods into the U.S.

Nintendo previously raised the price of the Nintendo Switch in August 2025, attributing the change to “market conditions,” which reflected economic and tariff pressures. The price of the newer Switch 2 model, however, has remained unchanged so far.

Observers note the case raises broader questions about the legality of tariffs enacted during specific periods and the financial impact those measures have on corporations that relied on predictable duty rules when importing products.
